Terms and Conditions


Scope of Application

Our General Terms and Conditions apply to all contracts for the delivery of goods from our shop that you conclude with us as a consumer or business (Evelina Storm, Falkenstr. 9, 30449 Hannover, Telephone: 01746977011, Email: bpc.storm@gmail.com).

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legally competent partnership that acts in the course of their commercial or independent professional activity when concluding a legal transaction.

Our General Terms and Conditions apply exclusively. Deviating, conflicting, or supplementary terms and conditions will only become part of the contract if we have expressly agreed to their validity. This requirement for consent applies in every case, for example, even if we execute the contract without reservation despite being aware of the terms.


Conclusion of Contract

The presentation of goods in our shop does not constitute a legally binding offer on our part to conclude a contract, but rather a non-binding invitation for you to submit a legally binding offer. You can submit this offer by selecting the desired goods, adding them to your shopping cart, completing the ordering process, and clicking the button that concludes the order process. Alternatively, you can also submit this offer via

- Email
- Post
submit.

We will confirm receipt of your offer to you immediately thereafter via email. This confirmation of receipt does not yet constitute acceptance of your offer.

We may accept your offer within five days, starting from the day after you submitted your offer, through the following alternatives:
- We send you an order confirmation via email, fax, or post. The decisive factor is the time at which you receive the order confirmation.
- We deliver the goods you ordered. The decisive factor is the time at which you receive the ordered goods.
- We request payment from you. The decisive factor is the time at which you receive the payment request.
- If you use one of the payment methods we offer, where you issue the payment instruction during the ordering process or by clicking the button that concludes the ordering process, or immediately after completing the ordering process, we hereby declare acceptance of your offer at the time you issue the payment instruction. Whether and for which payment methods this applies can be found in the 'Payment' section.

In the event of multiple acceptance options described above, the decisive factor for the time of acceptance of your offer is the one that occurs first.

If we do not accept your offer in a timely manner, it is considered rejected. You are then no longer bound by your offer.

 

Delivery and Shipping Address

  1. Delivery will be made to the shipping address provided by the customer.

  2. The customer is required to provide, during the ordering process, a complete and correct shipping address to specify.

  3. If an order is not delivered due to a wrongly or incompletely entered address not being delivered, we assume no liability for loss or additional shipping costs.

  4. After shipment a change of the delivery address is no longer possible.

  5. The goods are usually shipped on the same business day the payment is received dispatched.

  6. Orders with a product value of 60 € or more are free of shipping charges, provided no discount code or discount program is applied..


    When using a discount code or other discount promotions, free shipping may not apply, even if the order value exceeds 60 €.

    In this case, regular shipping costs will be calculated according to our shipping terms.


Shipping Method

We will make every effort to accommodate your shipping preference (e.g., DHL, DPD, or Hermes) and are happy to note your preference in the order comments.

However, the final decision regarding the shipping method rests with us and depends on shipping volume, the day's delivery type, and logistical circumstances.


Our goal is to deliver your order as quickly and securely as possible.

Retention of Title

The goods remain our property until full payment is made.


Contract Text

The contract text will be saved by us after the conclusion of the contract. We will send you the details of your order and our general terms and conditions via email.

If you create a customer account, you can view the details of your order after the contract has been concluded within the customer account. Our general terms and conditions – in their latest version – can be viewed at any time in our shop.

 

Vouchers / Discount Code

When using a voucher code or discount code, please note that certain promotional codes cannot be combined with free shipping offers.

Which discounts are combinable will be automatically checked and displayed in the shopping cart. There is no entitlement to combine multiple discounts.


Contract Language

The language available for concluding the contract is German.


Input Errors

You can review your inputs and identify any errors at any time before submitting an order. If necessary, use the zoom functions available in your browser to enlarge the display of your inputs. You can correct your entries using the correction aids provided during the ordering process and make new entries using your mouse and keyboard. You can cancel the ordering process at any time before submitting an order by closing your browser.


Right of Withdrawal

Prices

The prices listed in our shop are final prices and include the applicable statutory VAT, unless otherwise stated in the product description.

If shipping or transport costs apply, they will be listed separately in the product description.

For deliveries to countries outside the European Union, additional costs (customs duties, import VAT, currency exchange fees, and transaction fees, etc.) may arise, which are your responsibility and not within our scope of liability. Apple Pay
If you have selected Apple Pay as your payment method, you authorize a payment instruction as soon as you click the button that completes the order process. The payment is processed depending on your country of residence through Apple Distribution International Ltd., Ireland, or another company (viewable under https://www.apple.com/de/legal/internet-services/itunes/de/terms.html). Cash payment upon pickup
If you have chosen cash payment upon pickup as your payment method, you will pay the purchase price in cash when picking up the goods.

Google Pay
If you have selected Google Pay as your payment method, you authorize a payment instruction as soon as you click the button that completes the order process. In the European Economic Area (EEA) and Switzerland, Google services are provided by Google Ireland Limited, Ireland, a subsidiary of Google LLC, United States of America. SEPA Direct Debit
If you have selected SEPA Direct Debit as your payment method, the payment is due once you have granted us a SEPA Direct Debit mandate and the pre-notification period for the SEPA Direct Debit has expired. The payment will be collected as soon as we hand over the ordered goods to the shipping or transport service provider and the pre-notification period for the SEPA Direct Debit has elapsed.

Prepayment via Bank Transfer
If you have chosen prepayment via bank transfer as your payment method, the payment is due immediately after the contract is concluded. We will provide you with our bank details for this purpose. The delivery of the goods will take place after receipt of payment.


Delivery

We will deliver the ordered goods to the delivery address you provided during the ordering process.

If you wish to pick up the goods from us, you can select this option during the ordering process. In this case, no shipping or transport costs will be incurred. We will inform you by email as soon as the goods are ready for pickup and coordinate the pickup time with you. The pickup must take place at our location.


Retention of Title

If we provide advance performance (for example, in the case of purchase on account), the goods will remain our property until the full purchase price has been paid.


Warranty

The statutory defect liability rights apply.


Transport Damage

If goods are delivered with obvious transport damage, please report such errors to the shipping or transport service provider as soon as possible and contact us promptly. Failure to file a complaint or make contact will not affect your statutory or contractual warranty claims or their enforcement. However, this will help us assert our own claims against the shipping or transport service provider or transport insurance.


Dispute Resolution

We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.


Choice of Law

The law of the Federal Republic of Germany applies, excluding the conflict-of-law rules of private international law and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory provisions of the law in the country of your habitual residence remain unaffected.
